Paws And Pine sells pet portrait blankets, pine-and-campfire throws, pet lover hoodies, tees and small cabin gifts. Our artwork is original or generic, and we take it seriously when someone tells us a picture, a design or a piece of text on pawsandpine.shop copies their work. This page explains how to send us a copyright notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), what we do when one arrives, and how a person whose material was removed can respond. For trademarks, brand names and other concerns that are not copyright, please use our Intellectual Property Policy instead.
At a glance: copyright notices
- Email notices to [email protected] with the subject line “Copyright notice”.
- Written notices by post go to Paws And Pine, 760 N 7th St Apt 5304, San Jose, CA 95112, US.
- A complete notice has six parts, listed in section 3. Missing parts slow everything down.
- We confirm receipt within 24 hours on business days, then review the notice and act on valid claims.
- Anyone whose material is removed may send a counter-notice, described in section 6.
- Knowingly false notices or counter-notices can lead to liability for damages.
1. What this page covers
This process applies to anything published on pawsandpine.shop, including:
- product artwork, such as breed portraits, pine ridgelines, campfire scenes and cabin motifs on blankets, hoodies, mugs, pillow covers and ornaments;
- product and lifestyle images shown on product and collection pages;
- product descriptions, guides and the text of our help and policy pages;
- logos, icons and other graphics used around the site.
It also covers the photos customers send us for personalised products. Those photos are never published on the site: they are fetched from a share link, used only to print that customer’s order, and deleted 30 days after delivery. Even so, if you believe a customer has asked us to print a photograph you own, you can raise it with us using the same process, and we will look into any open order linked to it.
Paws And Pine is a single store selling its own products. There are no third-party sellers or marketplace listings on the site, so every notice comes straight to us and is handled by us.
2. Before you write: a few quick checks
Many concerns can be settled faster with a little context. Before sending a formal notice, it may help to consider:
- Is it the same work, or the same idea? Copyright protects a particular drawing, photo or text, not a general idea. Plenty of artists draw a dog by a campfire or a cat under pine trees. Similar themes are not by themselves copying; copying the actual expression is.
- Is it copyright, or a brand name? If your concern is about a name, logo or slogan used as a brand, that is a trademark issue. Use our Intellectual Property Policy process instead.
- Do you have the right to complain? Notices must come from the copyright owner or someone authorised to act for them.
If you are not sure, you are welcome to send an informal email first. Describe what you have seen and include the page link, and we will look at it with you. Some people simply want a credit line corrected or an image swapped, and that is often quick to arrange.
3. How to send a formal copyright notice
To be effective under the DMCA, your written notice must include all six of the following:
- A physical or electronic signature of the copyright owner or of a person authorised to act on their behalf. A typed full name at the end of an email is accepted as an electronic signature.
- Identification of the copyrighted work you say has been infringed. If several works are involved, a representative list is fine. A link to where your original is published, or a copy attached to the email, helps us compare.
- Identification of the material you say is infringing, with enough detail for us to find it. Please give the exact URL of each product or page, and say which image or passage you mean, for example “the second image on the 50 x 60 in sherpa throw page”.
- Your contact details: name, postal address, email address and a telephone number where you can be reached.
- A statement that you have a good-faith belief that the use of the material in the way complained of is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
Send the notice to [email protected] with the subject line “Copyright notice”, or by post to Paws And Pine, 760 N 7th St Apt 5304, San Jose, CA 95112, US. Email is faster, because support is handled by email only.
| Element | Why we need it | Common gap |
|---|---|---|
| Signature | Shows the notice is authorised | Unsigned notices sent from a generic address |
| Your original work | Lets us compare the two side by side | A description only, with no link or copy |
| Exact URL on our site | Lets us find the material quickly | Only the home page link, or “your hoodies” |
| Contact details | So we can reply and pass on any counter-notice | No postal address |
| Good-faith statement | Required by 17 U.S.C. § 512(c)(3) | Left out entirely |
| Accuracy statement under penalty of perjury | Required by the same section | Accuracy statement given without “under penalty of perjury” |
4. What happens after we receive a notice
- Acknowledgement. We confirm we have your notice within 24 hours on business days.
- Completeness check. If something on the checklist is missing, we tell you exactly what, so you can send the missing parts.
- Review. We compare the material against your work and check our own records for where the artwork or image came from.
- Action. If the notice is valid, we remove or disable access to the material, for example by taking down the image, retiring the design or unpublishing the product, and confirm this to you by email.
- Open orders. If a removed design is part of an order that has not yet been produced, we contact the customer, offer an alternative design or cancel with a full refund.
We aim to work through complete notices promptly. A clear, complete notice is the quickest route to a result.
5. Scenarios we see
An illustrator recognises their drawing
Say an artist believes a breed portrait on one of our throws traces their published drawing of a border collie. They send the six elements with a link to their original. We compare the line work, check our design records and, if the claim holds up, remove the design from sale and let any affected customers know.
A photographer spots their photo in a product image
If a scenic photo, such as a forest backdrop on a lifestyle image, is theirs and was not licensed, we remove or replace the image once the notice is confirmed.
A photo sent for a custom blanket
Customer photos are not published, but if you learn someone has ordered a blanket using your photograph without permission, tell us. Our Terms of Service require customers to have the rights to the photos they send, and we will hold or cancel an unproduced order while we look into it.
A text passage copied
If a product description or guide repeats text you wrote, point us to the exact passage. We rewrite or remove it.
6. Counter-notices
If material you supplied was removed and you believe that happened by mistake or because it was misidentified, you may send us a counter-notice. It must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Paws And Pine may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We pass a valid counter-notice to the person who sent the original notice. If they do not tell us within the period set by the DMCA that they have filed a court action, we may restore the material. We do not act as judge between the two sides; the law sets out this process so that a court can decide if the disagreement continues.
7. False claims and repeat issues
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, including costs and attorneys’ fees. Please be confident in your claim before you send it, and consider getting legal advice if you are unsure.
Where a customer repeatedly asks us to print photos or artwork they do not have rights to, we will decline further personalised orders from them.
8. How we try to avoid problems in the first place
Most of our catalogue is built from simple, outdoor-inspired motifs: silhouettes of pine ridges, a crackling fire ring, a cabin window at dusk, a sleeping dog curled on a plaid throw. We draw on general themes that belong to everyone and avoid copying any particular artist’s finished piece. Breed portraits show common breed features rather than a specific famous animal or someone else’s photograph.
On the personalisation side, we refuse requests that would copy a brand, sports team, cartoon or film character, or the name of a park or outdoor brand, and we ask every customer to confirm they own or have permission to use the photo they send. When a request looks like it may include someone else’s artwork, such as a screenshot of an illustration rather than a real photo of a pet, we may contact the customer or decline the order.
When our own work is copied elsewhere
If you see Paws And Pine artwork or product photos on another website or marketplace and want to let us know, we appreciate the tip. Send the link to [email protected]. We cannot reply with details of any action we take against another seller, but every report is read.
